While South Dakota generally prohibits corporations from engaging in the practice of medicine, it allows corporations to enter into employment agreements with physicians if the following criteria are met: the employment agreement may not interfere with a physician’s medical judgment; the corporation cannot charge higher fees than an independent physician would; and these agreements may not have an initial duration longer than three years without the renewal of annual renewal by mutual consent.
Can NPs and PAs practice independently in South Dakota?
NPs are required to work under a collaborative agreement for the first 1040 hours of practice until they can obtain full practice authority, while PAs are required to work under a supervision agreement with a physician.

After receiving appropriate training, LPNs may administer IV treatments. Mobile IV treatments are allowed.

Who can provide laser treatments in South Dakota?
MDs, PAs, and NPs may use lasers; LPNs and RNs may use non-ablative (lasers that do not damage the surface of the skin) as part of a treatment plan under an MD, PA, or NP. Cosmetologists and aestheticians are not allowed to use lasers of any kind.
